How drunk is too drunk to drive in Ohio? The best decision to make is to not drive if you have had anything to drink at all because people process alcohol differently. One drink can make a person relaxed and tipsy while another won’t feel a thing. Some people will register a high BAC level and another will be withing the legal limit.  Ohio has extremely tough penalties on drunk driving, and if you’re not sure whether you’re over the legal limit, it’s probably best to not get behind the wheel. Of course, everyone makes mistakes and if you are pulled over and arrested for a DUI, call a criminal defense attorney immediately.

Usually, men are able to drink more than women without being legally drunk, as  heavier people can drink more than lighter people. But, what needs to be realized, and usually is not, is that by the time someone feels drunk, they are way beyond the legal BAC limit and driving becomes impaired even after only one drink.

If you are stopped by law enforcement, and they believe you have been drinking, they will ask you to take a BAC test. You have the right to refuse this test. The BAC is just a measure of the amount of alcohol in your blood. It can be determined directly through blood testing or indirectly through breath, urine, or saliva testing. Legally, you must be 21 to drink in Ohio and for every adult, a  BAC of .08% or more is considered to be legally drunk, and not allowed to drive. If you are under 21, and found with a BAC of at least .02% but less than .08%, you will be charged with an OVAUC.

The numbers don’t mean a whole lot without more details. How many drinks does it take to be legally drunk in Ohio? It depends on the person’s weight, age, gender, type of alcohol consumed, the period of time the drink took to be finished, any medical conditions, etc. You will need a good and experienced criminal defense attorney presenting you side in court and showing whether police had reason to pull you over and that your rights were not violated. Was their a legit reason to pull you over?  A million ways to question the traffic stop.

The Bottom Line:  DUI charges have devastating repercussions on the accused, especially if innocent. As an experienced criminal defense attorney, I am here to learn your side of the story and to investigate the details of your arrest. You have rights and I am here to protect them. Call me the minute you are pulled over.  513-260-2099
